The complainant requested the cost of local evening programming on BBC local radio in England and the cost of Virtual Local Radio (ViLoR), a new technology for local radio. The BBC explained the information was covered by the derogation relating to information held for the purposes of journalism, art or literature and hence was excluded from the FOIA. The Commissioner’s decision is that this information was held by the BBC for the purposes of journalism, art or literature and so was not covered by the FOIA. She therefore upholds the BBC’s position and requires no remedial steps to be taken in this case. Information Tribunal appeal EA/2020/0083 under appeal.
