Kent County Council

The complainant requested from Kent County Council (the Council) information in relation to complaints submitted to the Council and the Council’s Trading Standards office in relation to a specific company. The Council neither confirmed nor denied holding information within the scope of the complainant’s request, citing section 44(2) of the FOIA (prohibitions on disclosure) as its basis for doing so. The Commissioner’s decision is that the Council correctly applied that exemption on the basis that the confirmation or denial was prohibited by section 237 of the Enterprise Act 2002 (EA02). The Commissioner does not require the Council to take any steps as a result of this decision notice.
