Crown Prosecution Service

The complainant has requested information about staff dismissed from a particular division of the Crown Prosecution Service (the ‘CPS’). The CPS advised that some of the information was not held and that the remainder was exempt from disclosure by virtue of section 40(2) (personal information) of the FOIA. The CPS subsequently revised its response and advised that it wished to rely on section 40(2) for all of the requested information. The Commissioner’s decision is that the CPS should have neither confirmed nor denied holding any information by virtue of sections 40(5A) and 40(5B)(a)(i) of the FOIA. No steps are required.
