Wiltshire Council

The complainant has requested from Wiltshire Council (the Council) information in relation to two planning applications. The Council refused to comply with the request, citing regulation 12(4)(b) (request is manifestly unreasonable) of the EIR. The Commissioner’s decision is that the Council was entitled to refuse the request under regulation 12(4)(b) of the EIR and that the public interest favoured maintaining the exception. The Commissioner requires no steps to be taken as a result of this decision notice.
