Cabinet Office

The complainant requested information on Cabinet Sub-Committee minutes on devolution from 1997 and 1998. The Cabinet Office refused the request in reliance of the exemption at FOIA section 35(1)(a) & (b) – Formulation of government policy, Ministerial communications. The Commissioner’s decision is that the exemptions are engaged in respect of the requested information, however, the public interest favours disclosure of the information. The Commissioner requires the public authority to disclose the requested information to ensure compliance with the legislation.
