The complainant has requested information relating to the recruitment and selection process for a particular role, gender break down of roles within a particular department and complaints. The BBC confirmed that it did not hold some of the requested information under section 1(1)(a) FOIA, it refused to comply with some parts of the request under section 12 FOIA as it would exceed the cost limit to do so and it withheld some of the requested information under section 40(2) FOIA. It provided some information originally withheld under section 40(2) FOIA to the complainant during the course of the Commissioner’s investigation (specifically the information requested at part 8 of the request). The Commissioner considers that the BBC correctly withheld information under section 40(2) FOIA. It correctly refused to comply with some parts of the request under section 12 FOIA and on the balance of probabilities, the remaining information requested is not held under section 1(1)(a) FOIA. The Commissioner requires no steps to be taken.
