Huntingdonshire District Council

The complainant has requested evidence held by Huntingdonshire District Council (the council) regarding ownership of a particular piece of land. The council refused the request because it believed it to be a repeat of a previous request made by the same complainant. The Commissioner’s decision is that the council was entitled to rely on section 14(2) of the FOIA in its refusal of the request. However, as the council failed to issue a refusal notice to the complainant within 20 working days, the Commissioner has found there to be a breach of section 17(5) of the FOIA. The Commissioner does not require the council to take any steps as a result of this decision notice. First-tier Tribunal (General Regulatory Chamber) Information Rights appeal EA/2021/0321 under appeal.
