Home Office

The complainant has requested statistics relating to deprivation of British nationality pursuant to section 40(2) of the British Nationality Act 1981 (“BNA”) from the Home Office. The Home Office refused to provide the requested information citing sections 22 (Information intended for future publication), 36(2)(c) (Prejudice to effective conduct of public affairs), 40(2) (Personal information) and 23(1) (Information supplied by, or relating to, bodies dealing with security matters) / 24(1)(National security) in the alternative. The Commissioner is satisfied that the withheld information is exempt from disclosure on the basis of sections 22 and 23(1) or, in the alternative, section 24(1) of the FOIA. No steps are required. Information Tribunal appeal EA/2021/0268 under appeal.
