Wigan Metropolitan Borough Council

The complainant requested information from Wigan Metropolitan Borough Council (“the Council”) about the Tree Preservation Order (TPO) relating to a specific address. The Council disclosed information in response, after redactions were carried out on the information - on the basis that it was third party personal data. Its position was that no other information was held, falling within the scope of the request and cited Regulation 12(4)(a) and Regulation 13 of the EIR to do so. The Commissioner’s decision is that he is satisfied that on the balance of probabilities, the Council holds no further relevant information, and that the information disclosed was correctly redacted under the exception for third party personal data: regulation 13 of the EIR. The Commissioner does not require the Council to take any steps.
