Southern Water Services Ltd (trading as “Southern Water”) declined to deal with the request under the EIR as it did not consider the requested information to be environmental. The Commissioner’s decision is that some of the requested information is not environmental information and therefore Southern Water was not required to deal with this part of the request under the EIR. The remaining information is environmental information, but it is also the personal data of third parties and thus exempt from disclosure under Regulation 13 of the EIR. The Commissioner does not require any remedial steps.
