Bristol City Council

The complainant requested a copy of a workplace parking levy (“WPL”) feasibility report to assess the readiness of Bristol City Council (“the council”) to develop a workplace parking levy scheme. The council applied regulation 12(4)(d) (material in the course of completion) of the EIR on the basis that the WPL feasibility report relates to, and feeds into, a decision pathway report which is not yet complete. The Commissioner’s decision is that the council correctly withheld the requested information under regulation 12(4)(d) of the EIR but that it failed to respond in time and breached regulation 5(2) of the EIR.
