Mid & South Essex Integrated Care Board

The complainant has requested information from Mid Essex Clinical Commissioning Group (the CCG), which is now Mid & South Essex Integrated Care Board, about patient choice in mental health secondary care providers. The CCG stated that it does not hold information within the scope of the request. The Commissioner’s decision is that, on the balance of probabilities, the CCG is correct when it says that it does not hold the requested information. However, the CCG breached section 10(1) of FOIA as it failed to provide a response to the complainant within the statutory time limit. The Commissioner does not require the public authority to take any steps as a result of this decision notice.
