The complainant made a request for information relating to contacts with BBC Scotland News relating to BBC Scotland’s News output. The BBC explained the information was covered by the derogation and excluded from FOIA. The Commissioner’s decision is that this information would be held by the BBC for the purposes of ‘journalism, art or literature’ and would not therefore fall inside FOIA. He therefore upholds the BBC’s position and requires no remedial steps to be taken in this case.
