Birmingham City Council

The complainant has requested information regarding the rates charged to Birmingham City Council for damage repairs on the road network, and details of claims. Birmingham City Council withheld some information on the basis of section 43(2) (commercial interests), and stated that some information was not held. The Commissioner’s decision is that section 43(2) was correctly applied and the public interest in maintaining the exemption outweighs the public interest in disclosure.
