Department for Energy Security & Net Zero

The complainant requested information relating to Shell’s proposed relocation of its headquarters to the UK. The Department for Business, Energy & Industrial Strategy (BEIS) provided some information in response to the request but refused to disclose the remainder on the basis of section 43(2) (commercial interests) of FOIA. The Commissioner’s decision is that the information is exempt from disclosure on the basis of section 43(2) and that the public interest favours maintaining the exemption. In addition, on the balance of probabilities, BEIS held no further recorded information relevant to the complainant’s request and has complied with section 1(1) of FOIA. No steps are required.
