The complainant requested information from the Department of Health and Social Care (“DHSC”) about pay information for consultants by pay threshold, gender, ethnicity and age. The Commissioner’s decision is that DHSC has not demonstrated that complying with the request would impose a grossly oppressive burden and consequently it is not entitled to rely on section 14(1). The Commissioner requires DHSC to take the following step to ensure compliance with the legislation: To respond to the request again, without relying upon section 14(1) of FOIA. DHSC must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of FOIA and may be dealt with as a contempt of court.
