North East Lincolnshire Council

The complainant requested from North East Lincolnshire Council (‘the council’) information relating to any investigation carried out by the council in respect of a named company, including correspondence with third parties and other information. The council applied section 12 (appropriate limit) to part of the request. It also applied section 40(5A) to refuse to confirm or deny whether personal data is held about two named individuals. Furthermore, it applied section 30(1)(b) in respect of the information held as part of an investigation. The Commissioner’s decision is that the council was correct to apply the exceptions cited. The Commissioner does not require the council to take any steps.
