Salford City Council

The complainant requested compliance records and road inspections reports for “the roads in Salford” over the past six years. Salford City Council (the ‘Council’) refused to comply with the request citing section 12 (cost of compliance exceeds appropriate limit) of FOIA. The Commissioner’s decision is that the Council was entitled to refuse to comply with the request in accordance with section 12(1) of FOIA. The Commissioner also finds that the Council has complied with its obligations under section 16 of FOIA to offer advice and assistance. However, whilst noting the Council’s explanation, he finds that the request was not responded to within the statutory 20 working days’ time limit which is a breach of section 10(1) of FOIA. No steps are required as a result of this notice.
