Environment Agency

The complainant requested information from the Environment Agency (EA) relating to salmon stock exploitation rates. EA refused the request under regulation 12(4)(b) as manifestly unreasonable. The Commissioner’s decision is that EA is entitled to rely on regulation 12(4)(b) of the EIR to refuse to comply with the request and that the public interest favours maintaining the exception. However, EA breached regulation 14(2) of the EIR by not issuing a refusal notice stating that it was relying on an exception within the statutory timeframe. The Commissioner does not require any steps.
