The complainant requested information relating to a complaint about their neighbour. Durham County Council (the “council”) refused to confirm or deny whether any relevant information was held, citing section 40(5B)a(i) of the FOIA. The Commissioner’s decision is that the council was entitled to rely on section 40(5B)a(i) of the FOIA to refuse to confirm or deny whether any information was held. The Commissioner does not require the council to take any steps.
