Birmingham City Council

The complainant requested information from Birmingham City Council (“the Council”) about some renovation works at a Council property. The Council withheld some of the requested information, citing section 43(2) of FOIA (prejudice to commercial interests) as its basis for doing so. The Commissioner’s decision is that the Council has correctly relied on section 43(2) of FOIA and that the balance of the public interest favours maintaining this exemption. The Commissioner does not require the Council to take any steps.
