The complainant has requested information relating to extradition proceedings in respect of Julian Assange. The Crown Prosecution Service (‘CPS’) would neither confirm nor deny (‘NCND’) whether it held the requested information, citing section 30(3) (Investigations and proceedings) of FOIA. The Commissioner’s decision is that the CPS was entitled to rely on section 30(3) to NCND holding the requested information.
