Braintree District Council

The complainant requested a copy of legal advice from Braintree District Council (‘the council’) about a planning application which was under appeal. The council refused the request, applying regulation 12(5)(b) of the EIR. The Commissioner’s decision is that the council was correct to apply regulation 12(5)(b) to withhold the information from disclosure. The Commissioner does not require the council to take any further steps.
