The complainant has requested information relating to the procedure for retrofitting classic cars in order to reduce their emissions. The Department for Transport’s (“DfT”) position is that it does not hold the requested information. The Commissioner’s decision is that, on the balance of probabilities, DfT does not hold any information in relation to the request and has correctly applied regulation 12(4)(a) of EIR, but that it failed to carry out an internal review within the statutory time limit and breached regulation 11(4) of EIR. The Commissioner does not require further steps.
