Ministry of Defence

The complainant submitted a request to the Ministry of Defence (‘MOD’) seeking a copy of his late father’s medical record for a particular period in 1944. The MOD confirmed that it held information falling within the scope of the request but refused to disclose this on the basis of section 41(1) (information provided in confidence) of FOIA. The Commissioner’s decision is that the MOD is entitled to refuse to disclose the information on the basis of section 41(1) of FOIA. No steps are required as a result of this decision.

FOI 41(1): Complaint not upheld

Decision notice: 246825
