Chief Constable of Cambridgeshire Constabulary

The complainant has requested information about an action undertaken by Cambridgeshire Constabulary. In compliance with a previous decision notice, Cambridgeshire Constabulary disclosed some information but withheld the remainder citing sections 38(1) (Health and safety) and 40(2) (Personal information) of FOIA. An email attachment was located during the course of the Commissioner’s investigation. This was fully withheld under section 40(2) of FOIA. The Commissioner’s decision is that Cambridgeshire Constabulary was entitled to rely on section 40. He also finds that, on the civil standard of the balance of probabilities no further information is held. No steps are required.
