Devon County Council

The complainant has requested background information relating to a standards committee hearing from Devon County Council (‘the council’). The council refused to provide the information, citing section 36(2)(b)(i) and (ii) (prejudice to the effective conduct of public affairs) and section 40(2) (personal data) of FOIA to withhold the information. The Commissioner’s decision is that the council was correct to withhold the information under sections 36(2)(b) and section 40(2). The Commissioner does not require the council to take any steps.
