Sheffield City Council

The complainant requested a copy of advice provided to Sheffield City Council (‘The Council’), regarding a Public Inquiry held in 2007. The Council refused to confirm or deny whether it held information within the scope of the request, citing section 12(2) (cost of compliance exceeds appropriate limit) of FOIA. The Commissioner’s decision is that the Council was entitled to rely on section 12(2) of FOIA. However, he finds that the Council failed to provide reasonable advice and assistance and therefore did not meet its obligations under section 16(1) of FOIA. The Commissioner does not require the Council to take any steps.
