South Tyneside Council (‘the Council’) relied on section 40(2) of FOIA (third party personal information) to withhold some of the information and section 36(3) to neither confirm or deny holding the remaining information. The Commissioner’s decision is that: The Council has correctly relied on section 40(2) of FOIA to withhold some of the information. The Council was entitled to rely on section 36(3) when refusing to confirm or deny holding the remaining information. The Commissioner does not require further steps to be taken.
