South West Water

The complainant has requested information about discharges from South West Water Limited. South West Water Limited (“the public authority”) refused to provide the requested information, citing regulation 12(5)(b) (The course of justice and inquiries exception). The Commissioner’s decision is that the withheld information doesn’t engage regulation 12(5)(b). Therefore the public authority isn’t entitled to withhold it. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: disclose the requested information.
