Summary
The opposition was based on the opponents' mark BION, in Class 5. Under Section 5(2)(b) the Hearing Officer found that the marks were neither the same nor similar. Although that decided the matter under Section 5(2) he went on to find that the goods were not similar, either. Under the remaining grounds of Sections 5(3) 5(4)(a) and 56 the Hearing Officer found that the opponents had not filed the requisite evidence relating to goodwill and reputation.
