Summary
By a preliminary decision of an officer of the Registry, the registered proprietor was given an extension of time in which to file evidence under Rule 13(6) of the Trade marks Rules 1994 (as amended). The applicants challenged this decision and asked for reasons in writing, but they did not ask for a hearing neither, in the opinion of the Hearing Officer, did they provide a full written argument against the decision, as required by the Practice Director then in force (1 January 1999). Reviewing the matter the Hearing Officer confirmed the preliminary decision of the Registry Officer.
