The Hearing Officer considered that the mark applied for was "at the margins of what is capable of distinguishing" and in the absence of evidence or argument on the point he made no finding under Sections 1(1) and 3(1)(a).
Under Sections 3(1)(b) and 3(1)(c) the Hearing Officer found that the mark was devoid of distinctive character and that it described the kind, quality and intended purpose of the goods.
