The opposition was based on the opponents’ use and prior application for registration, of the mark REGGAE. No evidence was put forward in support of the ground under Section 3(6); this ground was dismissed accordingly. The Hearing Officer found that the opponents’ mark was similar and was proposed for registration in respect of the same goods in an application which pre-dated the application in suit. Opposition under Section 5(2)(b) therefore succeeded.
