Summary
The applicant for revocation withdrew its application before the hearing, with no evidence filed. As the grounds raised by the applicant had been considered during pre-grant examination, the Hearing Officer declined to re-examine them ex parte and made no order for revocation. A claim by the defendant for compensatory costs, on the grounds that there had been abuse of process, was rejected and costs on the normal scale were awarded.
