Summary

In respect of GB 9614154.4, the applicants failed to respond to the first examination report which raised a novelty objection. Despite several reminders, extensions of time and warnings about the impending expiry of the rule 34 period, the application eventually ran out of time. The HO decided that the novelty objection was well-founded and refused the application under section 20(1).

During proceedings on this application, a new application, GB 9912424.0, for a related invention, was filed. An incomplete Form 9/77 was filed without the search fee. No claims or abstract were filed. The HO refused the application under section 15(5).
