Summary
The applicants alleged that the existence of an earlier mark, LEE RIDERS, had meant that the mark in suit was registered contrary to Section 5(2). The Hearing Officer however, concluded from the differences between the marks, that there was no likelihood of confusion. The application failed accordingly. The same parties and the same marks were involved in (i) an opposition under the Trade Marks Act 1938 (BL O/509/01) and (ii) an application for revocation (BL O/511/01).
