Summary
The opponents based their opposition (to the Class 16 element only) on their marks VINTAGE and VINTAGE plus device of the sun’s face, registered in Class 16. Neither they nor the applicants filed evidence, made submissions or requested a hearing. The Hearing Officer noted that identical goods were involved even after the deletion of books from the specification in the application, since "printed matter" includes books.
Having compared the mark, however, he concluded that there was no likelihood of confusion.
