Summary

The opponents were owners of the mark LAWGIC, registered in the UK in Classes 9, 41 and 42.

The Hearing Officer found the services specified in the application to be the same as or similar to the opponents’ Class 42 specification. He went on to compare the marks. For "practical intents and purposes" he confined his comparison to the marks LAWGIC and LAWGYM. He found the visual, aural and conceptual differences to be such that no confusion would be likely to arise, remarking, inter alia, that a customer for legal services would be "relatively careful"; this was not a casual "bag of sweets" case. The opposition failed
