Summary
The opponents were applicants for four registrations in Classes 9, 36 and 41, of the marks LOMBARD RISK, & LOMBARD RISK GROUP OF COMPANIES.
The Hearing Officer considered the similarity in the marks and the similarity in most of the goods and services gave rise to a likelihood of confusion and found that the opposition under Section 5(2)(b) succeeded (except in respect of Classes 37 and 38). However, since the opponents’ marks had not yet achieved registration he stayed the decision pending the eventual outcome of the opponents’ applications.
