Appeal to the Appointed Person not proceeded with: Costs awarded to the opponent.
Points Of Interest
Summary
The applicant appealed the Hearing Officer's decision dated 17 July 2002 (BL O/276/02) to the Appointed Person. In the event the appeal was not proceeded with and the opponents requested costs. Before making an award the Appointed Person asked the opponent to justify their request with an itemized summary of the work carried out. He also asked the applicant for their comments in relation to the claim by the opponent.
Subsequently the opponent claimed the sum of £660 and the applicant raised no objection to the claim. Having considered the papers on file the Appointed Person decided that a fair award would be £575 and he so ordered.
