Summary
The defendant having filed with its evidence an application to amend the specification, the claimant requested an extension of one month to file its evidence in reply, on the grounds that the defendant had delayed seeking amendment, the amendments had resulted in a new case to answer, and that the claimant was preparing evidence for corresponding proceedings in Singapore and monitoring proceedings on the re-opened examination of the corresponding European application. Distinguishing between the filing of evidence in reply and the filing of further evidence in chief, the hearing officer refused to grant any extension. The hearing officer noted that because the Offices delay in writing to the claimant, it had effectively had a period of 14 weeks to file evidence in reply.
