Summary
In his earlier decision (see BL O/102/04) the Hearing Officer had found the opposition under Section 5(2)(b) partially and provisionally successful, dependent on the eventual outcome of the opponent’s Community Trade Mark application. That application had now been registered. This decision, therefore, was merely to set out the reduction in the specification which the applicants would be required to apply for. Failure to amend the specification as required would result in refusal of the whole application.
