Summary
Mr Mackie sought to remove Mr Charles Faulder and Mr Richard Faulder as named inventors claiming that their inclusion as inventors resulted from an oversight by the patent agent. Mr Charles Faulder and Mr Richard Faulder however both claimed to have made inventive contributions. It was held that Mr Mackie had failed to satisfy the burden of proof that was on him as the claimant and therefore his claim was refused.
