Summary
The opposition was based on a CTM registration of the mark Creamers, also in Class 33.
The respective specifications covered identical goods; the Hearing Officer therefore proceeded to a comparison of the marks, following which she concluded that whilst there were some similarities there were also significant differences. Overall, she found no likelihood of confusion and the opposition under Section 5(2)(b) failed.
