Summary
Separate applications under section 13(1) and 13(3) were filed by Epic Systems Corporation. These were subsequently consolidated. Consent was filed by each of those having an interest in the applications with the exception of Samit Govind Sureka, who was declared deceased on 29 August 2001, and Baiming Zou. Baiming Zou was invited to file a counter-statement in relation to the proceedings but failed to do so. Furthermore, he did not respond to an additional letter from the Office advising that the proceedings would be treated as unopposed. As such, the comptroller considered the applications to be unopposed and found that Aaron T Cornelius should be mentioned as a joint inventor in the granted patent. The comptroller also found that the name of Baiming Zou should be removed from the list of inventors and directed that an addendum slip be prepared mentioning Aaron T Cornelius as a joint inventor and stating that Naiming Zou should not have been mentioned as an inventor. The decision serves as a certificate, issued in accordance with section 13(3), to the effect that Baiming Zou should not have been mentioned as an inventor in the granted patent for the invention.
