The registered proprietor conceded non-use during the relevant period and offered no proper reasons of non-use. However it was claimed that use had commenced during the period set out in Section 46(3).
Having examined the evidence, however, the Hearing Officer found nothing to suggest that actual trade had occurred or was imminent.
The mark was revoked accordingly.
