Summary
The registered proprietor claimed that there had been use and, at the same time, claimed that there had been proper reasons for non-use (his illness).
Having examined the matter the Hearing Officer found that there had been no use and he also found that the proprietor’s illness need not have prevented use during at least some of the relevant period.
The mark was revoked accordingly.
