Summary
The opposition was based on the opponents’ mark QUEEN, registered in classes 9, 16, 25 & 41. The objection related solely to the class 25 specification.
The goods were identical; the matter therefore hinged on a comparison of the marks.
Whilst the Hearing Officer did not think it likely that the marks would be directly confused with one another there was the possibility of association and hence a likelihood of confusion.
The opposition succeeded accordingly, in respect of the Class 25 goods.
