At the hearing it emerged that the applicants’ case in defence of the application was based on the proviso to Section 3(1); hence the objections under 3(1)(b) (c) and (d) were, in effect, conceded.
In the result the Hearing Officer found that the applicants’ evidence did not support a case under the proviso. Hence the mark was not registrable and had to be refused.
